Abstract

A will is a trust that must be conveyed, so that the trust cannot be concealed or given to another person who is not entitled. So far, many wills have been neglected and various ways have been done so that the will does not reach the rightful, because that is why the verses of the Qur'an came down to regulate the will and make people who change and falsify the will as a great sinner. This research is normative with a historical and regulatory approach to the Egyptian State Law. The obligatory will of the State of Egypt applies to a grandchild whose parents have died first in the life of the grandfather or grandmother, such a situation in the compilation of Islamic law is included in the realm of successor heirs, while the obligatory will of article 209 in KHI only to children or parents lift. If seen from the difference between the obligatory will law of the State of Egypt and KHI in Indonesia, which both have similarities in the limits of the obligatory will section, which is 1/3. KHI pays great attention to children or adoptive parents so that a mandatory will is enforced, this shows that KHI in Indonesia not only cares about the welfare of the same family, but also cares about others who have served in his life.
