Abstract
Penelitian dilatarbelakangi realitas putusan Mahkamah Konstitusi 18/PUU-XVII/2019 tentang pengujian Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Adapun fokus kajiannya adalah aspek perlindungan hak spiritual konsumen dalam penyelesaian sengketa wanpretasi pembiayaan murabahah. Untuk membahasnya digunakan metode penelitian dengan jenis penelitian hukum doktrinal yang bertumpu pada tiga bahan hukum, yaitu primer, sekunder dan tersier yang didapat melalui studi pustaka dan dianalisa secara deksriptif kualitatif. Adapun hasil penelitian ini adalah bahwa penyelesaian sengketa wanprestasi pembiayaan murabahah berdasarkan Putusan MK No. 18/PUU-XVII/2019 dapat dilakukan: (a) di luar pengadilan secara musyawarah. Pada konsteks ini agar konsumen terlindungi hak spiritualnya dapat dilakukan secara hybrid mediasi-arbitrase pada badan arbitrase syariah atau pada Lembaga Alternatif Penyelesaian Sengketa Sektor Jasa Keuangan (LAPS SJK), namun karena kedua lembaga ini tidak mudah diakses konsumen, maka Badan Penyelesaian Sengketa Konsumen (BPSK) dapat diberi kewenangan terhadapnya dengan kewajiban menerapkan prinsip syariah dalam kasus sengketa wanprestasi pembiayaan syariah. Kedua, dapat dilakukan di pengadilan agama dengan melalui mekanisme gugatan sederhana. (The research is motivated by the reality of the decision of the Constitutional Court 18/PUU-XVII/2019 regarding the review of Law Number 42 of 1999 concerning Fiduciary Guarantees. The focus of the study is on the aspect of protecting the spiritual rights of consumers in the settlement of the murabahah financing default dispute. To discuss this research method is used with the type of doctrinal legal research that relies on three legal materials, namely primary, secondary and tertiary obtained through literature study and analyzed descriptively qualitatively. The results of this study are that the settlement of the murabahah financing default dispute based on the Constitutional Court Decision No. 18/PUU-XVII/2019 can be carried out: (a) out of court by deliberation. In this context, so that consumers' spiritual rights can be protected, hybrid mediation-arbitration can be carried out at the sharia arbitration body or at the Financial Services Sector Alternative Dispute Resolution Institution (LAPS SJK), but because these two institutions are not easily accessible to consumers, the Consumer Dispute Resolution Agency (BPSK) ) may be given authority over it with the obligation to apply sharia principles in the case of a sharia financing default dispute. Second, it can be done in a religious court through a simple lawsuit mechanism.)
