Abstract

A question that often arises in the aspect of law enforcement is why law enforcement in resolving cases that have occurred in Indonesia so far, is considered never in accordance with the justice desired by the community. Cases of gross human rights violations in the past, starting from the tragedy of 1965-1966 to the case of Human Rights Activist Munir Said Thalib in 2004 and a series of other unresolved legal cases, both at the elite level of power, to the common people. The resolution of these legal cases provides an important lesson for the community that it is not easy to seek, obtain and even fight for justice. These cases never find a bright spot. Over time, these legal cases have never been revealed again. This is what raises questions for everyone about where justice is. In the process of resolving legal cases, a more in-depth investigation needs to be carried out. Therefore, a new paradigm is needed in law enforcement in Indonesia, starting from legal ideas, legal formulation and legal implementation. The goal of these three indicators is justice based on Islamic values in terms of politics and economics in society.
