Abstract

This article examines the Bahtsul Masail Nahdlatul Ulama's decision regarding the permissibility of the childfree trend in Indonesia through the lens of the al-dzari’ah theory. The growing childfree trend in the modern era has sparked various viewpoints and controversies, particularly concerning economic, health, and cultural aspects. Utilizing the al-dzari’ah theory, which emphasizes preventive measures to avert harm, this article delves into the fatwa related to the potential impacts of the childfree trend. This research employs a qualitative method with critical analysis of the fatwa's content to reassess the Nahdlatul Ulama's fatwa on the childfree trend and its implications. The findings indicate that the NU fatwa permits the childfree trend, provided it does not result in a permanent cessation of childbirth potential. However, this permission applies to individuals without any efforts for mass propaganda or campaigns, and it should not promote the notion that having children is undesirable. Furthermore, the decision to be childfree should be accompanied by regular reproductive health check-ups for women as a preventive measure against potential long-term negative health impacts (sadd al-dzari’ah).
