Abstract

The implementation of Islamic family law principles in mixed-marriage families in South Korea, particularly those involving Indonesian and Korean couples, reflects a complex interplay of cultural, religious, and legal factors. This study explores the challenges and dynamics of applying these principles within a multicultural context, using Social Construction Theory as a framework. Marriage in Islam is viewed not only as a personal bond but as a commitment to creating a harmonious and stable family, characterized by sakinah, mawaddah, and rahmah (peace, love, and mercy). Several key principles guide Islamic marriage, including choosing a partner wisely, ensuring equality, mutual respect, consultation, and acceptance. In the case of mixed marriages, couples face numerous challenges, particularly in the early stages of marriage, due to language, cultural, and religious differences. However, many couples manage to find common ground by adopting a tolerant approach, respecting each other’s beliefs, and integrating Islamic teachings gradually into their family life, especially in raising children. The role of religious education, especially for converts, is crucial, and the support of the Muslim spouse is often central to overcoming cultural and religious obstacles. Additionally, legal issues such as visa status and residence permits often influence these marriages. Through the lens of Social Construction Theory, the study highlights how these couples navigate their differences by adjusting cultural and religious values. Despite the challenges, many families have successfully internalized Islamic family law principles, creating a dynamic and resilient family structure in a multicultural South Korean society.
