Abstract

Israel’s military aggression against Palestine has brutally claimed the lives of thousands. There are approximately 41,000 casualties, 97,166 injured, and 11,000 missing persons. This fact has elicited strong responses from various countries. Solidarity for the suffering of the Palestinian people has been shown by Muslims in Indonesia. The Indonesian Ulema Council responded by issuing Fatwa Number 83 Year 2023, which supports the struggle of the Palestinian people. One form of this support is to boycott products affiliated with Israel. This fatwa deserves specific scrutiny, as it has sparked both support and opposition. Supporters see the fatwa as a concrete step in supporting Palestine, while opponents argue that it will lead to a decline in production and result in potential layoffs. This article is an empirical study with a qualitative method that presents and analyzes the data, offering a descriptive text related to Fatwa Number 83 Year 2023 on supporting the Palestinian struggle and the boycott of pro-Israel products. The aim of this study is to review the fatwa through the lens of Jasser Auda’s maqāsid al-sharī’ah, in order to provide a more objective perspective in strengthening Islamic studies that are humanistic, tolerant, moderate, and applicable to all times and places. The results of the study show that: 1) Several fast-food restaurants in Malang have been affected by this fatwa. One of the impacts is a decline in production and employee layoffs. 2) When it is analyzed using Jasser Auda’s maqāsid al-sharī’ah framework, the fatwa only correlates with the cognitive aspect, while contradicting the other five aspects.
