Abstract

Polygamy remains a controversial topic in the study of Islamic family law, particularly in the context of its relevance in contemporary society, which demands equality and the protection of women's rights. The purpose of this research is to analyze how Fazlur Rahman's Double Movement theory can be used to reinterpret the verses on polygamy in Surah An-Nisa, verse 3, and to examine the practice of polygamy in the contemporary era.
The main issues studied include how the basic principles of multiple transfer are understood in the context of polygamous verses and how these principles are implemented in the analysis of contemporary polygamous practices. This research uses a qualitative method with a library research approach sourced from scientific journals and academic documents. Research findings indicate that polygamy in the early Islamic context was a social response to the issue of justice for widows and orphans, rather than an ideal family norm. In its current application, most polygamy practices fail to meet the principles of substantive justice and instead cause harm. Therefore, the application of the dual movement theory confirms that the current restriction on polygamy is consistent with the moral objectives of the Quran. The novelty of this research lies in the integration of Fazlur Rahman's hermeneutic analysis with contemporary social realities, resulting in a new reading that polygamy is a contextual social mechanism, not an ideal norm. The implications of this research indicate the need for stricter and more protective regulations on polygamy, as well as the importance of the maqāṣid approach in the development of modern Islamic family law.
