Abstract

Law No. 22 of 2022 concerning Corrections regulates that female prisoners and their children (congenital children) must be separated for a maximum age of 3 years, so that children’s rights are vulnerable to not being fulfilled. The purpose of this study is to identify the implementation of the state’s responsibility in fulfilling the rights of children of their mothers who are prisoners at the Women’s Correctional Institution Class IIA Malang and analyse it using the perspective of Law No. 35 of 2014 concerning Child Protection. This type of research uses empirical juridical with a sociological juridical approach. LPP Malang has implemented Article 62 of Law No. 22 of 2022, The Mandela Rules and The Bangkok Rules, but it is less significant in fulfilling the rights of congenital children. To overcome these problems, (1) it is necessary to affirm the rights of congenital children in the Correctional Act and the Child Protection Act, (2) funding for congenital children for growth and development needs is held, (3) a coaching programme on childcare and supervision is held to ensure the implementation of the protection of congenital children who are separated from their mothers for the best interests of the child in the future
