Abstract

The President, as the number one person, should ideally uphold the pillars of Democracy, not the other way around. In practice, the President does not heed the principles of democracy by making an 'endorsement' to the Presidential candidate. In this regard, it is necessary to conduct an in-depth study of the problem of the President's endorsement and its impact on the Sustainability of Democracy in Indonesia, from Sadd Al-Dzari'ah's perspective. This research focuses on the role of the President's endorsement in the sustainability of democracy in Indonesia, as well as its relationship to responsive law and Sadd Al-Dzari'ah. The research method used is normative juridical, using 2 approaches: the statute approach and the conceptual approach. The legal sources used are primary legal sources, namely the 1945 Constitution, the Election Law, and PKPU; secondary legal materials, including books and journal articles; and tertiary legal materials in the form of KBBI and news through websites. This study uses qualitative juridical analysis. The findings of this study are: 1) The President's endorsement does not have a strict legal instrument that can explicitly regulate his actions, but if reviewed further, the President's endorsement attitude clearly causes legal constraints in the Election Law. The responsive legal theory is also aligned, because the President's endorsement will harm election principles. 2) The President's endorsement attitude will also open up space for political non-neutrality, potential abuse of power, as well as injustice in election contests that are likely to hurt election principles. This is in line with the principle in Sadd Al-Dzari'ah, which states that if the benefit received is not proportional to the much greater mudharat obtained, the meal should be abandoned.
