Abstract

Traffic accidents constitute a form of social risk that results in serious losses, including bodily injuries, property damage, and the death of family members. The state provides protection through the Road Traffic Accident Fund as regulated under Law Number 34 of 1964 and Government Regulation Number 18 of 1965. However, in practice, the regulation concerning the status of victims and the scope of heirs entitled to compensation continues to generate juridical and social problems, as it does not fully reflect substantive justice. This study aims to analyze the concepts of victims and heirs within the prevailing Road Traffic Accident Fund regulations and to formulate a more equitable regulatory reconstruction. This research employs a normative legal research method with statutory, conceptual, and comparative approaches. The analysis is conducted through an examination of positive legal norms and the social realities that develop within society. The findings demonstrate that the definition of victims and the limitation on the scope of heirs under the current positive law remain social protection.
