Abstract

The relationship between maqashid sharia and economic requires the use of maqashid analysis in the construction of Islamic economic theories and policies. Actually, maqashid sharia analysis strengthen the character of social teaching and muamalah in Islam that is goal oriented. This methods try to elaborate the universal principles with the particular rules, prioritize the expediency and avoid the damage, and consider the impact in establishing a legal and policy.
This study uses qualitative methods of literature by an interdisciplinary approach. Tracing the source of documents and studies using descriptive-analytic to collect, reduce, and verify and present the source. Interpretation methods are used to support data analysis descriptive.
In this paper, maqashid analysis procedure is used to evaluate the theories and policies on free ownership and reconstruct the Islamic concept of free property rights.
