Abstract

This research is qualitative, an empirical study with Malang’s Islamic banking as its object of study on the implementation of murabaha financing’s contract in Malang’s Islamic banking in perspective of Compilation of Islamic Economics Law (KHES) and Fatwa of the National Sharia Board-Indonesian Ulema Council (DSN-MUI), There are three main problems discussec in this study: 1) how the provisions of akad (contract) murabaha in Compilation of Islamic Economics Law and Fatwa of the National Sharia Board-Indonesian Ulema Council?; 2) how the implementation of murabaha financing’s contract in Malang’s Islamic banking in perspective of Compilation of Islamic Economics Law and Fatwa of the National Sharia Board-Indonesian Ulema Council?; 3) what the constraints faced by Malang’s Islamic banking in implementing murabaha contract in financing products?

Using legislation (statute aprroach), researchers analyzed and verified field data with KHES and fatwa of DSN-MUI. The data collection technique used questionnaire (quiz) were analyzed using an interactive model and descriptive-quantitative.

This study obtained three conclusions: 1) The provisions of murabahah contract is set quite clearly in KHES chapter V (Bai' consequences), specifically in the sixth section of the Bai' Murabahah and the seventh section of the Conversion Murabaha Agreement, whereas the provisions in fatwa of DSN-MUI are similar with KHES, but it got more numerous and detailed than the provisions in KHES. It's understandable, because KHES -which refer to fatwa DSN-MUI- published in 2008, while fatwa of the DSN-MUI -which began in 2000- can still issue fatwas until now; 2) Implementation of the agreement murabaha financing in Malang-s Islamic banking is already quite good, because 66% of the practices are in accordance with the KHES and fatwas of DSN-MUI, while 34% are not; 3) There are three main constraints faced by Malang’s Islamic banking in implementing murabaha contract in financing products, namely: a) lack of public awareness to ask for financing in BS; b) lack of understanding and knowledge about the financing and murabaha contract; c) the lack of government support.
