Abstract

This article examines the application of two methods in addressing differences in fatwas related to contemporary zakat law, namely al-jam'u wa taufiq (reconciliation) and naskh (abrogation of previous law). The al-jam'u wa taufiq method seeks to reconcile classical Islamic legal texts with modern realities without nullifying existing laws, while naskh is used to abrogate old laws deemed irrelevant in contemporary conditions. This study focuses on the cases of professional zakat and stock zakat as examples of the application of these two methods. Literature analysis shows that the use of al-jam'u wa taufiq allows for harmonization between classical law and contemporary needs, while naskh provides space for legal innovation. By comparing the application of both methods, this article concludes that both can offer effective solutions depending on the context and situation. The article concludes by emphasizing the importance of modern ijtihad in maintaining the relevance of zakat law in the era of globalization.
